Mediation

ProgramAccording to the American Bar Association*, mediation can offer a quick, inexpensive alternative to litigation, allowing parties a way to work out their differences while addressing everyone’s needs and interests. Decisions reached in mediation are created by the people who are in conflict, not imposed on them by a judge.

Mediation

  • encourages direct communication between the parties
  • helps people decide for themselves
  • allows for the expression of emotions
  • defuses anger
  • explores creative means of solving problems
  • promotes cooperation
  • preserves the strengths of an ongoing relationship
  • helps people accept the consequences of their own decisions
  • develops a model for resolution of future conflicts

Why Choose Mediation?

  • Faster than going to court; in weeks not years
  • Lower cost. Court costs can exceed benefits.
  • Private, while court cases are public record
  • Informal and Interpersonal. Mediation is less intimidating than a courtroom, and can deal with multiple parties and issues at a time. Parties look to the future instead of finding fault or blame.

Where Do I Start?

Most mediations begin when two or more parties find themselves at an impasse and consult their lawyers. A lawyer typically seeks out a mediator as an alternative to taking the conflicted issue to court. However, you can inquire about mediation services for business purposes without a lawyer.
