The National Labor Relation Board’s Final Rule requiring most employers to post a notice of employee rights has been delayed indefinitely. On April 17, 2012, the Court of Appeals for the District of Columbia issued an injunction delaying the effective date of the rule. The ruling follows the decisions of federal district courts in the District of Columbia, which invalidated the NLRB’s authority to enforce the rule, and South Carolina, where the court struck down the rule in its entirety. As a result of the conflicting decisions at the district court level, the D.C. Circuit has enjoined enforcement of the Final Rule pending appeal.
