Estate & Wealth Planning, Trust Administration, and Probate

Ashley’s practice focuses on helping families and individuals with estate and wealth planning matters including drafting and modifying trusts, wills, powers of attorney, and premarital agreements.  She additionally helps clients proceed through the probate process.  Ashley also regularly works with clients on complex estate planning issues, including drafting a wide variety of different types of trusts, and working on transition plans for closely-held businesses.

Ashley also assists clients with a vast array of trust administration issues including modification, division, severance, decanting, termination, removal or change of trustee, trust protector or trustee appointments, changing situs, and numerous other trust issues.  Ashley also regularly reviews trusts drafted by out of state attorneys for South Dakota validity.  She helps her clients achieve their objectives both non-judicially and through formal court approval. Clients Ashley works with for trust and estate issues include individuals, families, trust companies, trustees, bank trust departments, financial advisors, businesses, and charitable organizations.

Trust Companies

Ashley’s practice additionally focuses on assisting in the creation and compliance of trust companies under South Dakota law, including helping public and private trust companies charter in South Dakota, drafting necessary policies and procedures, and working with trust companies on a wide range of post-charter compliance issues.  She also helps trust companies with their many trust administration issues as described above.

Business and Corporate Law & Cyberlaw

Ashley is also a business and corporate attorney, assisting clients with entity formation and a broad variety of planning, transaction, employment, real estate, and other business and corporate matters. Along with being known for her trust and estates and trust company work, Ashley is also known for cyberlaw and assisting her business and corporate law clients with the legal side of digital issues that affect their businesses, including privacy policies and terms of use for websites, e-commerce, digital contracts including service and hosting agreements, domain disputes, online marketing compliance, software contracts, data breaches, social media issues in employment, and a wide variety of other digital issues.

About Ashley

Originally from Sioux Falls, Ashley graduated with honors and a dual-major from Harvard University.  She obtained her JD, ranked first in her class, and with Sterling Honors, from the University of South Dakota.  In law school, Ashley received an unprecedented 23 Dean’s Certificates for Outstanding Performance/CALI Awards for the top grade of any student in her classes and obtained the first and second only perfect semesters in the history of the law school.  Ashley was the recipient of numerous awards and scholarships, including the prestigious Gavel Award and Everett Bogue Scholarship. She served as the Lead Articles Editor on her school’s law review, was a graduate assistant for Dean Tiffany Graham and Professor Frank Pommersheim, and founded and served as president of the Internet and Cyber Law Society organization at her law school. Prior to law school, Ashley spent a few years abroad including time working at several prestigious law firms in Australia.

In her free time, Ashley enjoys running, hiking, playing board games, and spending time with her husband and dog.
