Hanson Presents Webinar on At-Will Employment

Sandra Hoglund Hanson presented a webinar titled, “It’s Elementary – Or Is It?  The Demise of the At-Will Employment Safe Harbor,” on December 3, 2013, in conjunction with Howalt University.  In this webinar, Ms. Hanson discussed the current status of the at-will employment doctrine in South Dakota.  She described recent court cases which make it risky for employers to terminate employers without carefully delineated reasons, explained at the time of termination.  These cases, along with federal and state anti-discrimination laws, reveal that employers who refuse to tell employees why they are being terminated from employment may later have trouble proving their termination decisions were based on legitimate, non-discriminatory reasons if those employees decide to pursue legal actions against their employers for the terminations.  Hanson provided cautions to employers and identified best practices for employers to discipline and, if needed, terminate employees from their employment.
